CITY OF MERIDIAN SOCIAL MEDIA TERMS OF USE STATEMENT

Social media sites are intended to provide important, relevant and engaging information to Users, specifically regarding City of Meridian business, events, and programs. Any comment or materials posted by a User of this site may be attributed only to that User, and does not necessarily reflect the positions or opinions of the City of Meridian, its employees or officials. The City of Meridian does not warrant the accuracy of any statement or claim made here, is not responsible for any User generated content, and does not endorse any opinion expressed here. If you disagree with any part of these Terms of Use, please do not use any City of Meridian social media sites and immediately exit the City's social media site you are currently accessing. All Users must comply in all respects with the City of Meridian' s Terms of Public' s Use for this site. The following terms of use shall also apply:

A. The City’ s primary designated agent under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(2) and 37 C.F.R. § 201.38) is the Meridian City Attorney, DMCA-1027661, registered at http:// www.copyright. gov. Repeat infringers’ use will be suspended, and may be temporarily or permanently blocked or discontinued.

B. The City seeks to serve all of its constituents by hosting an open but civil dialogue. Reasonable arguments for opposing views are encouraged.

C. Users shall have no right of privacy on the City's social media sites, as such sites may be or contain public records subject to disclosure pursuant to the Idaho Public Records Act and the City's records retention schedule.

D. Communications, comments, messages, discussions, and dialogue on the City of Meridian’ s social media sites are monitored by the City of Meridian’ s Communications Team during business hours. We strive to reply to comments and questions and may rely on other City departments or external partners to generate a response.

E. A comment posted by a member of the public on any City social media site is the opinion of the commentator or poster only. Publication of a comment does not imply endorsement of, or agreement by, the City of Meridian, nor do such comments necessarily reflect the opinions or policies of the City of Meridian.

F. Comments should relate to the topic being discussed in the original post, should not contain random or unintelligible information or text, and should not be wholly an advertisement of commercial products or services.

G. Comments on our social media sites are allowed. Due to the prevalence of malicious software and for the safety of our residents, posting links, images, and videos by others to externally generated content is not allowed. Comments containing or uploading any of the following inappropriate forms of content are subject to removal and/ or restriction:

1. Content that is deemed in violation of City policy, these terms of use, the terms and conditions of use of [Name of Site], or any applicable federal, state or local law;
2. Profane, obscene, indecent, violent, or pornographic content;
3. Content that promotes, fosters or perpetuates discrimination on the basis of race, creed, color, age, religion, gender, gender identity, sexual orientation, or national origin;
4. Defamatory or personal attacks;
5. Threats to any person or organization;
6. Encouragement or incitement of illegal activity;
7. Information that may tend to compromise the safety or security of the public or public systems;
8. Spam, scams, or fraudulent or deceptive messages;
9. Content that provides personally identifiable medical information of someone other than the commenter;
10. Content that violates a known legal ownership interest, such as a copyright or trademark of any party; or
11. Any content that contains or perpetuates a virus, corrupted file, or other defect or program that may cause damage.

H. Comments provided on the City’ s social media sites are not considered formal public comments in relation to City business or other matters under formal review by the City. Public Records Requests should not be made on the City’ s social media sites. Please make such requests at https:// meridiancity. org/ city-clerk/ public- records/. Do not report emergencies or ask for assistance on social media sites. For emergency, police, or fire services, call 9-1-1.

I. We can’t guarantee the security of information you share on social media sites. By commenting, you waive any rights you may have to material, images, or comments you post. You grant the City of Meridian perpetual, non-exclusive license to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify, and adapt in any form or media now known or hereinafter developed, any submission posted by you on this site. You waive any rights you may have in having the material altered or changed in a manner not agreeable to you. By submitting content, you are consenting to its display on the site and for related online and offline promotional uses.

J. All use of this site shall be bound by the City of Meridian's terms and conditions of use. Where appropriate, City may report any violation of such terms and conditions to [Name of Site].

K. These terms may be revised at any time.

L. A User' s submission, posting, or other publication of a comment constitutes acceptance of these terms.
